Beverly Gold Exchange (“we,” “us,” “our,” or the “Company”) operates the website located at beverlygoldexchange.com (the “Site”) and provides jewelry valuation, appraisal, buying, secondhand article trading, luxury item consignment, and secured pawn services at our physical showroom located at 131 North Robertson Blvd, Beverly Hills, CA 90211.

PLEASE READ THESE TERMS OF SERVICE (“TERMS”) CAREFULLY BEFORE USING THIS SITE OR ENGAGING IN ANY TRANSACTION WITH US.

By accessing or using our Site, submitting an online appraisal or appointment request, communicating with us, bringing items to our showroom for inspection, or entering into any buying, selling, or pawn transaction, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you must immediately cease using the Site and our Services.

1. Eligibility and Authorized Use

Age Requirement: You must be at least eighteen (18) years of age and legally capable of forming binding contracts under California and federal law to use this Site or engage in any transaction with us.
Authority: If you are accessing the Site or submitting items on behalf of another individual, estate, or legal entity, you represent and warrant that you have full legal authority to bind that party to these Terms.

2. Purpose of Website & Non-Binding Nature of Online Estimates

A. Information Purposes Only

All content on the Site, including guides, articles, gold price charts, description of bought items, and valuation tools, is provided for general informational purposes only. Nothing on the Site constitutes formal financial, legal, tax, investment, gemological certification, or official appraisal advice.

B. Online Appraisal Requests & Preliminary Estimates

Estimates Are Non-Binding: Any monetary ranges, preliminary quotes, or estimates provided via our online forms, email, phone, text, or chat are strictly non-binding informational estimates offered for convenience only. They do not constitute an offer to purchase, a guaranteed payout, or a binding agreement.
In-Person Physical Inspection Required: Final binding offers can only be issued after an in-person physical inspection of the item by our valuation specialists at our Beverly Hills location.
Factors Affecting Final Offers: Final offers depend on physical verification, weight, purity, spot market prices at the exact time of transaction, diamond color/clarity, brand authenticity, completeness (box, papers, accessories), physical condition, and current secondary market demand.
Right to Decline: We reserve the absolute right, at our sole discretion, to decline an estimate, refuse an appointment, or decline to purchase or loan against any item for any reason.

3. Seller Warranties: Title, Ownership, and Authenticity

When you submit an item for appraisal, offer an item for sale, or pledge an item for a pawn loan, YOU REPRESENT, WARRANT, AND COVENANT UNDER PENALTY OF PERJURY THAT:

Sole Ownership & Clear Title: You are the legal, 100% sole owner of the item, or an authorized legal agent with full power to sell or pledge the item. The item is free and clear of all liens, encumbrances, claims, security interests, mortgages, or marital property disputes.
Not Stolen Property: The item has not been obtained through theft, burglary, robbery, fraud, embezzlement, conversion, or any other illegal means.
Authenticity: To the best of your knowledge, the item is authentic, genuine, and not a replica, counterfeit, altered, or fraudulent reproduction. (e.g., watches are original without aftermarket counterfeit components unless explicitly disclosed in writing).
Accuracy of Information: All photographs, receipts, GIA certificates, service records, and provenance documents provided by you are accurate, unaltered, and complete.

CRITICAL LEGAL NOTICE REGARDING STOLEN PROPERTY AND FRAUD:

We work directly with the Los Angeles Police Department (LAPD), Beverly Hills Police Department (BHPD), and national stolen property databases (CAPSS / JUS8733 / LeadsOnline). Attempting to sell or pledge stolen goods or counterfeit items is a crime under California Penal Code § 496 and federal law. We will report all suspected fraudulent, counterfeit, or stolen items, along with seller identification, IP addresses, and surveillance footage, to law enforcement immediately.

4. In-Person Inspection, Testing, and Physical Evaluation Consent

To accurately determine precious metal purity, gemstone specifications, and luxury item authenticity, our staff must perform physical and chemical evaluations.

By delivering, handing over, or submitting any item to Beverly Gold Exchange for inspection, YOU EXPRESSLY AUTHORIZE AND CONSENT TO THE FOLLOWING:

Testing Methods: Testing may include ultrasonic cleaning, microscopic examination, electronic metal testing, X-Ray Fluorescence (XRF) spectrographic analysis, acid scratch testing on touchstones, diamond thermal testing, and removal of watch case backs or movement inspections.
Inherent Risks of Physical Testing: Acid testing and touchstone testing require minor rubbing of precious metals. Opening watch case backs or inspecting stone settings carries inherent risks to vintage or delicate items.
Limitation of Inspection Liability: You agree that Beverly Gold Exchange, its gemologists, and technicians shall not be liable for minor, necessary, or pre-existing wear, scratches, or marks resulting from standard professional testing procedures. If an item is discovered to be gold-plated, base metal, or counterfeit during testing, we are not responsible for any cosmetic alteration caused by uncovering the underlying base metal.

5. Precious Metals and Market Fluctuations

Prices for gold, platinum, silver, diamonds, luxury watches (e.g., Rolex, Patek Philippe, Audemars Piguet), and bullion fluctuate continuously based on global spot markets and economic conditions.

Spot Price Changes: Verbal or written quotes are valid only for the immediate moment they are issued. Spot prices applied to a transaction are locked in only upon final execution of a signed buy-sheet or pawn agreement.
No Best Price Guarantees: Unless explicitly agreed in writing, we do not guarantee that our offer is the highest market price or that we will match third-party quotes.

6. Pawn Loans and Secondhand Goods Transactions

All pawn loans, pledges, outright purchases, and trade transactions executed in person at our Beverly Hills showroom are governed by applicable California statutes, including:

The California Pawnbroker Law (California Financial Code Division 8, § 21000 et seq.);
California Business and Professions Code governing Secondhand Goods Dealers and Precious Metals Buyers;
Federal Anti-Money Laundering (AML) regulations and the USA PATRIOT Act.

Specific terms regarding loan duration, interest rates, state-mandated administrative fees, grace periods, redemption, and forfeiture of collateral will be set forth in your official signed California Pawn Ticket / Pledge Agreement issued at the time of the transaction.

7. Prohibited Uses of the Site

You agree not to use the Site to:

Submit false, misleading, fraudulent, or defamatory information, descriptions, or appraisal uploads;
Impersonate any person or entity or misrepresent your affiliation with any person or entity;
Upload files containing viruses, Trojan horses, ransomware, or malicious code;
Use scrapers, bots, web crawlers, or automated data extraction tools to mine Site content;
Interfere with the proper security, network infrastructure, or performance of the Site.

We reserve the right to block, restrict, or terminate your access to the Site without notice if we suspect any breach of these Terms.

8. Intellectual Property Rights

All content, branding, logos, text, graphics, designs, photography, layout, and software on the Site are owned by or licensed to Beverly Gold Exchange and are protected by United States and international copyright, trademark, and trade dress laws.

Third-Party Trademarks: Brand names such as Rolex, Patek Philippe, Audemars Piguet, Cartier, Omega, GIA, and other trademarks mentioned on the Site are the registered trademarks of their respective owners. Beverly Gold Exchange is an independent buyer, seller, and pawn broker of pre-owned luxury items and is not affiliated with, endorsed by, or sponsored by any of these brand manufacturers.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ITS CONTENT, ONLINE ESTIMATES, AND ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Beverly Gold Exchange EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES;
WARRANTIES THAT AN ONLINE ESTIMATE WILL MATCH A FINAL IN-PERSON EVALUATION OR THAT ANY OFFER WILL BE ACCEPTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, Beverly Gold Exchange, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES;
ANY PRELIMINARY ONLINE ESTIMATE OR COMMUNICATIONS;
DAMAGE OR LOSS TO ITEMS SENT VIA UNAPPROVED OR UNINSURED THIRD-PARTY SHIPPING SERVICES;
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY FOR CLAIMS RELATING TO THE USE OF THIS SITE EXCEED THE AMOUNT YOU SPECIFICALLY PAID TO US TO USE THE SITE (WHICH IS GENERALLY $0.00) OR $100.00 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless Beverly Gold Exchange, its owners, managers, employees, agents, and legal representatives from and against any third-party claims, liabilities, losses, damages, costs, or expenses (including reasonable attorney fees) arising from or related to:

Your breach of these Terms or your seller warranties (Section 3);
Misrepresentation of ownership, authenticity, or title of any item submitted;
Your violation of any federal, state, or local law, or the rights of any third party;
False or fraudulent information submitted through our Site or in person.

12. Dispute Resolution: Mandatory Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

A. Informal Resolution First

In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the Site, an appraisal, or a transaction with Beverly Gold Exchange, you agree to first contact us at info@beverlygoldexchange.com and attempt to resolve the dispute informally in good faith for at least thirty (30) days.

B. Mandatory Binding Arbitration

If informal resolution fails, any unresolved dispute, claim, or controversy shall be settled exclusively by binding arbitration administered by the American Arbitration Association (AAA) or JAMS in Los Angeles County, California, under its Commercial Arbitration Rules.

You and Beverly Gold Exchange understand that arbitration replaces the right to go to court, and both parties expressly waive any right to a trial by jury.
Judgment on the arbitration award may be entered in any court having jurisdiction thereof.

C. Class Action Waiver

YOU AND Beverly Gold Exchange AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

13. Governing Law and Venue

These Terms and any dispute arising hereunder shall be governed by, construed, and enforced in accordance with the laws of the State of California, without regard to its conflict of law principles. To the extent any judicial proceeding is permitted under these Terms (e.g., enforcement of arbitration awards), you consent to the exclusive jurisdiction and venue of the state or federal courts located in Los Angeles County, California.

14. Severability and Integration

If any provision of these Terms is found to be unlawful, void, or unenforceable by an arbitrator or court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. These Terms, along with our Privacy Policy and any signed physical transaction agreements (Pawn Tickets / Buy Sheets), constitute the entire legal agreement between you and Beverly Gold Exchange.
